These Terms of Service ("Terms") govern your use of whitepearlyachts.com and any yacht charter services provided by White Pearl Yachts. By booking a charter, you agree to these Terms.

1. Definitions

  • "Operator" refers to White Pearl Yachts.
  • "Client" or "you" refers to the person making the reservation.
  • "Charter" refers to the vessel rental service including captain and crew.
  • "Deposit" refers to the $100 USD non-refundable booking fee.

2. Booking and Deposit

  • All bookings are confirmed only after the $100 deposit is paid through whitepearlyachts.com.
  • The deposit secures the date and vessel — it is non-refundable except as specified in our Cancellation Policy.
  • The remaining balance is due before boarding, payable via card, Zelle, or cash (USD).
  • The Client must be at least 18 years old and provide valid government-issued ID at check-in.

3. Pricing

  • All prices are in U.S. dollars (USD) and exclude gratuity, fuel surcharges over included range, food, beverages, and water toys unless specified.
  • A 6.5% Florida sales tax applies to the charter fee.
  • Captain gratuity (15–20%) is customary and appreciated.

4. Inclusions and Exclusions

Included: licensed captain, crew, fuel within agreed range, ice, basic snorkel gear (subject to availability), bluetooth sound system.

Not included unless agreed: food, alcohol, jet skis, water toys, decorations, photographer, dockage at restaurants, tips, taxes.

5. Captain's Authority

The Captain has absolute authority over the vessel for safety reasons. The Captain may:

  • Cancel or shorten the charter due to weather, mechanical issues, or unsafe sea conditions.
  • Refuse boarding or terminate the trip if guests are intoxicated, behave dangerously, or violate Florida or maritime law.
  • Decide routes, anchoring points, and return time for safety.

6. Capacity and Safety

  • Maximum capacity per vessel is strictly enforced as per U.S. Coast Guard regulations.
  • Children must be accompanied by an adult at all times and wear a life jacket when required.
  • Swimming is at the guest's own risk and only when authorized by the Captain.

7. Prohibited Conduct

The following are strictly prohibited on board:

  • Illegal drugs of any kind.
  • Smoking inside enclosed cabins.
  • Glass containers (for safety).
  • Excessive intoxication or disorderly conduct.
  • Throwing objects overboard.
  • Sitting on bow railings or unsafe areas while underway.

Violation may result in immediate termination of the charter without refund.

8. Damage and Liability

  • The Client is responsible for any damage caused to the vessel by guests during the charter.
  • White Pearl Yachts and the Captain are not liable for personal injuries, lost or damaged personal property, or actions of third parties beyond their reasonable control.
  • Guests participate in water activities at their own risk.

9. Force Majeure

Neither party is liable for failure to perform due to events beyond reasonable control: hurricanes, tropical storms, government orders, marine emergencies, port closures, pandemics, etc. See Cancellation Policy for reschedule options.

10. Intellectual Property

All content on whitepearlyachts.com — photos, videos, logos, copy — is the property of White Pearl Yachts and may not be reproduced without written permission.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, United States of America. Any dispute will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida.

12. Severability

If any provision of these Terms is found invalid, the remaining provisions remain in full force.

Estos Términos y Condiciones rigen el uso de whitepearlyachts.com y cualquier servicio de chárter de yates prestado por White Pearl Yachts. Al reservar un chárter, aceptás estos Términos.

1. Definiciones

  • "Operador" se refiere a White Pearl Yachts.
  • "Cliente" se refiere a la persona que realiza la reserva.
  • "Chárter" se refiere al servicio de alquiler de embarcación con capitán y tripulación.
  • "Depósito" se refiere a la tarifa de reserva no reembolsable de USD $100.

2. Reserva y Depósito

  • Las reservas se confirman únicamente luego de pagar el depósito de $100 a través de whitepearlyachts.com.
  • El depósito asegura la fecha y la embarcación — es no reembolsable salvo lo especificado en nuestra Política de Cancelación.
  • El saldo restante se paga antes de abordar: tarjeta, Zelle o efectivo (USD).
  • El Cliente debe ser mayor de 18 años y presentar identificación oficial al check-in.

3. Precios

  • Todos los precios están en dólares estadounidenses (USD) y no incluyen propinas, recargos de combustible fuera del rango, comida, bebidas ni juguetes acuáticos, salvo que se especifique.
  • Aplica un impuesto de venta del 6.5% de Florida sobre la tarifa de chárter.
  • La propina al capitán (15–20%) es costumbre y se agradece.

4. Inclusiones y Exclusiones

Incluye: capitán con licencia, tripulación, combustible dentro del rango acordado, hielo, equipo básico de snorkel (sujeto a disponibilidad), sound system bluetooth.

No incluye salvo acuerdo: comida, alcohol, jet skis, juguetes acuáticos, decoración, fotógrafo, atraque en restaurantes, propinas, impuestos.

5. Autoridad del Capitán

El Capitán tiene autoridad absoluta sobre la embarcación por motivos de seguridad. Puede:

  • Cancelar o acortar el chárter por mal tiempo, problemas mecánicos o condiciones de mar inseguras.
  • Negar el abordaje o terminar el viaje si los invitados están intoxicados, se comportan peligrosamente o violan la ley de Florida o marítima.
  • Decidir rutas, puntos de fondeo y hora de regreso por seguridad.

6. Capacidad y Seguridad

  • La capacidad máxima por embarcación se respeta estrictamente según regulaciones de la U.S. Coast Guard.
  • Los niños deben estar acompañados por un adulto en todo momento y usar chaleco salvavidas cuando corresponda.
  • Nadar es bajo riesgo del huésped y solo cuando lo autorice el Capitán.

7. Conducta Prohibida

Las siguientes conductas están estrictamente prohibidas a bordo:

  • Drogas ilegales de cualquier tipo.
  • Fumar dentro de cabinas cerradas.
  • Recipientes de vidrio (por seguridad).
  • Intoxicación excesiva o conducta disruptiva.
  • Arrojar objetos al mar.
  • Sentarse en barandas de proa o áreas inseguras en navegación.

El incumplimiento puede resultar en la terminación inmediata del chárter sin reembolso.

8. Daños y Responsabilidad

  • El Cliente es responsable de cualquier daño causado a la embarcación por sus invitados durante el chárter.
  • White Pearl Yachts y el Capitán no son responsables por lesiones personales, pérdida o daño de objetos personales, ni acciones de terceros fuera de su control razonable.
  • Los huéspedes participan en actividades acuáticas bajo su propio riesgo.

9. Fuerza Mayor

Ninguna parte es responsable por incumplimiento debido a eventos fuera de su control razonable: huracanes, tormentas tropicales, órdenes gubernamentales, emergencias marítimas, cierres de puerto, pandemias, etc. Ver Política de Cancelación para opciones de reagendamiento.

10. Propiedad Intelectual

Todo el contenido de whitepearlyachts.com — fotos, videos, logos, textos — es propiedad de White Pearl Yachts y no puede reproducirse sin permiso escrito.

11. Ley Aplicable y Jurisdicción

Estos Términos se rigen por las leyes del Estado de Florida, Estados Unidos de América. Cualquier disputa se resolverá exclusivamente en los tribunales estatales o federales del condado de Miami-Dade, Florida.

12. Divisibilidad

Si alguna disposición de estos Términos se considera inválida, el resto sigue en vigor.
